兗州煤業股份(01171.HK)收到兩份應訴通知書 將作為第三人蔘加訴訟
格隆匯6月11日丨兗州煤業股份(01171.HK)公佈，公司於2020年6月9日收到兩份呼和浩特市中級人民法院《應訴通知書》，分別為（2020）內01民初第279號和（2020）內01民初第280號，均為中國華融資產管理股份有限公司內蒙古自治區分公司訴鄂爾多斯市金誠泰化工有限責任公司等合同糾紛案，通知公司作為第三人蔘加訴訟，該案將於2020年7月1日開庭。
2012年7月31日，原告中國華融與被告金誠泰簽訂《權利質押合同》，約定被告金誠泰以其對兗州煤業21億餘元應收賬款為案涉債權提供質押擔保。擔保範圍包括債權本金、重組收益、罰息、複利、違約金、損害賠償金、保管擔保財產和實現債權、質權費用和其他所有應付的費用。2013年8月11日，被告金誠泰向原告出具《承諾函》，承諾在《債務重組協議》及其補充協議項下債權本息清償完畢之前，被告金誠泰已質押給原告的股權轉讓應收賬款將為延期後債務繼續提供擔保。《權利質押合同》簽訂後，原告與被告金誠泰在中國人民銀行徵信中心辦理了質押登記，並於2018年9月19日辦理了展期登記。
訴訟請求判令被告金誠泰償還原告欠款本金，上述欠款截至2016年12月31日的重組收益、複利和原告為本案支出的律師費合計人民幣4.5億元；判令第三人兗州煤業將應付給被告金誠泰股權轉讓款中的上述本金、重組收益、複利及律師費金額部分直接支付給原告。
此外，2012年12月24日，原告與被告金誠泰簽訂《權利質押合同》，約定被告金誠泰以其對兗州煤業21億餘元應收賬款為案涉債權提供質押擔保。擔保範圍包括債權本金、重組收益、罰息、複利、違約金、損害賠償金、保管擔保財產和實現債權、質權費用和其他所有應付的費用。《權利質押合同》簽訂後，原告與被告金誠泰在中國人民銀行徵信中心辦理了質押登記，並於2018年9月19日辦理了展期登記。
訴訟請求判令被告金誠泰償還原告欠款本金、上述欠款重組收益、複利和原告為本案支出的律師費合計人民幣6.8億元；判令第三人兗州煤業將應付給被告金誠泰股權轉讓款中的上述本金、重組收益、複利及律師費金額部分直接支付給原告。
因本次訴訟尚未開庭審理，尚無法判斷作為第三人蔘加訴訟對公司期後利潤的影響。
