世紀華通(002602.SZ)子公司訴前行為保全獲法院支持 法院裁定娛美德娛樂、傳奇IP立即停止在中國大陸向任何第三方進行涉及網絡遊戲《LEGEND OF MIR II》改編權授權
格隆匯12月18日丨世紀華通(002602.SZ)公佈，近日，公司的控股子公司亞拓士軟件有限公司(“亞拓士公司”)收到江西省宜春市中級人民法院(“宜春市中院”)寄送的(2019)贛09行保1號《民事裁定書》。
亞拓士公司與娛美德娛樂有限公司(“娛美德公司”)為遊戲軟件《LEGEND OF MIR II》(中文名《傳奇》)的共有著作權人。亞拓士公司認為娛美德公司、株式會社傳奇IP(“傳奇IP”)擅自與深圳市椰子互娛網絡技術有限公司(“深圳椰子公司”)、江西椰子互娛網絡技術有限公司(“江西椰子公司”)簽訂《MIR2 PC Client Game and Web Page Service Operation and Management Agreement》等行為，侵犯了其合法權益。
鑑於娛美德公司在中國大陸地區的非法授權行為，亞拓士公司向宜春市中院申請訴前行為保全，請求法院：
1、責令娛美德娛樂有限公司、傳奇IP立即停止在中國大陸地區向任何第三方進行涉及網絡遊戲《LEGEND OF MIR II》(中文名《傳奇》)的改編權授權；
2、責令娛美德公司、傳奇IP、深圳椰子公司、江西椰子公司立即停止履行其非法簽署的授權協議《MIR2 PC Client Game and Web Page Service Operation and Management Agreement》。
裁定結果：“1、娛美德娛樂有限公司、株式會社傳奇IP立即停止在中國大陸向任何第三方進行涉及網絡遊戲《LEGEND OF MIR II》(中文名：《傳奇》)改編權授權；
2、娛美德娛樂有限公司、株式會社傳奇IP、深圳市椰子互娛網絡技術有限公司、江西椰子互娛網絡技術有限公司立即停止履行其簽署的授權協議《MIR2 PC Client Game and Web Page Service Operation and Management Agreement》。”
截止目前，被申請人娛美德公司、傳奇IP已就(2019)贛09行保1號《民事裁定書》提出複議申請。此外，亞拓士公司已依法提起訴訟並已繳納案件受理費。
