中铝国际(02068.HK)：法院冻结华大公司多处房产及2918.49万元存款
格隆汇9月10日丨中铝国际(02068.HK)发布公告，公司全资子公司贵阳院承包公司与华大公司之间就“安顺华大时代广场项目”签署了《安顺华大时代广场项目总承包合同》《安顺华大时代广场项目三方协议》等合同，贵阳院承包公司因华大公司未按约定履行偿还或支付有关款项和费用的义务，于2018年12月11日向位于贵州省的贵阳仲裁委员会提出仲裁申请，2018年12月24日，贵阳仲裁委员会受理了贵阳院承包公司的仲裁申请。
2019年8月，仲裁庭认为贵阳院承包公司与华大公司之间约定的债务履行期限尚未届至，贵阳院承包公司关于债权提前到期的主张不成立，故作出裁决驳回申请人贵阳院承包公司的仲裁请求。
贵阳院承包公司认为，根据垫资协议的约定，其已足额为华大公司进行垫资，并经双方确认。但在垫资完成后，华大公司未按合同约定向贵阳院承包公司提供打六折后能覆盖贵阳院承包公司债权的抵押物并办理抵押登记，经贵阳院承包公司多次催促后仍然未按合同约定的期限提供。根据《贵阳仲裁委员会裁决书》认定的事实和合同约定，在贵阳院承包公司两次通知华大公司并给出20日履行期限后，华大公司仍然未履行合同义务的新法律事实出现的情况下，贵阳院承包公司依法有权宣布所有债权全部到期，要求华大公司立即清偿所有债务并赔偿相应经济损失。
因此，基于以上理由，贵阳院承包公司就与华大公司之间的承包合同纠纷，再次向贵阳仲裁委员会提交仲裁申请书。近日，贵阳院承包公司收到贵阳仲裁委员会出具的《贵阳仲裁委员会仲裁通知书》，并已缴纳仲裁相关费用。具体仲裁请求内容如下：（一）请求依法确认申请人向被申请人华大公司垫资的债权全部到期，裁决被申请人华大公司立即归还申请人垫资款本金22,000.00万元及资金占用费12,424.95万元；（二）请求裁决确认申请人对“安顺华大时代广场项目”一期工程折价或变现后在4,950.50万元（该款系申请人担任总承包期间实际垫资施工完成的工程款，包含在垫资7,000万元工程款中）范围内享有优先受偿权；（三）请求裁决被申请人华大公司支付申请人补偿费13,952.14万元。
贵阳院承包公司就本次仲裁申请了财产保全，贵州省安顺市中级人民法院于近日出具了《贵州省安顺市中级人民法院结案通知书》，华大公司如下财产已被查封：1.华大公司名下“安顺华大时代广场项目”一期房屋600套。2.华大公司名下土地，权证号：黔（2016）安顺市不动产权第0000733号，面积5948平方米；权证号：黔（2018）安顺市不动产第0001843号，面积21557.58㎡；权证号：黔（2018）安顺市不动产第0001842号，面积17084㎡。3.冻结华大公司工商银行安顺体育场支行银行账户的存款2,918.49万元。
